INTRODUCTION

Welcome to Prairie Ranchers Beef. These Terms of Service ("Terms") govern your use of the Prairie Ranchers Beef website located at prairieranchersbeef.ca (the "Website") and your purchase of products from Prairie Ranchers Beef, a brand owned and operated by Prairie Farm Foods Inc. ("PFF," "we," "us," or "our").

By accessing or using our Website, creating an account, or purchasing our products, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Website or purchase our products.

As a Canadian company based in Alberta, we operate under Canadian federal and provincial laws, including the Consumer Protection Act of Alberta and applicable federal regulations governing food sales and distribution.

DEFINITIONS

  • "Products" refers to all beef products, merchandise, and related items offered for sale through our Website
  • "Services" refers to our direct-to-consumer delivery service and related customer support
  • "Account" refers to the customer account you may create on our Website
  • "Order" refers to your request to purchase Products through our Website 

ELIGIBILITY AND ACCOUNT REGISTRATION

Age Requirements

You must be at least 18 years of age to create an Account or make purchases. By using our Website, you represent that you meet this age requirement.

Account Creation

To make purchases, you may need to create an Account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your login credentials
  • Update your information as necessary to keep it accurate
  • Accept responsibility for all activities under your Account 

Account Termination

We reserve the right to suspend or terminate Accounts that violate these Terms or engage in fraudulent activity. 

PRODUCT INFORMATION AND AVAILABILITY

Product Descriptions

We strive to provide accurate descriptions, weights, and images of our Products. However, we do not warrant that Product descriptions or other content on the Website is completely accurate, reliable, or error-free.

Availability

All Products are subject to availability. We reserve the right to limit quantities and discontinue Products at any time without notice.

Pricing

All prices are listed in Canadian dollars (CAD) and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without notice, though price changes will not affect Orders already confirmed.

ORDERING AND PAYMENT

Order Process

When you place an Order, you are making an offer to purchase Products. We reserve the right to accept or decline any Order at our discretion.

Payment

We accept major credit cards and other payment methods as displayed on our Website. Payment is required at the time of Order placement.

Order Confirmation

Once your Order is placed and payment is processed, you will receive an email confirmation. This confirmation constitutes our acceptance of your Order.

DELIVERY POLICY

Direct-to-Consumer Beef Bundle Packaging and Transport

Prairie Farm Foods delivers frozen vacuum-sealed meat products directly to your door using our delivery partner. All products are in vacuum-packed packages and may be packed in boxes with dry ice, then delivered using refrigerated delivery trucks to ensure your order remains frozen throughout transit. Our priority is to ensure your order arrives safely, remains frozen, and is delivered in a way that is convenient for your household.

Delivery Procedure

Deliveries are made to the shipping address provided at checkout. Once your order is dispatched, you will receive an email confirmation, followed by an SMS notification when your delivery is en route.

Drivers will communicate directly with customers at the time of delivery, either in person, by phone, or by text, to confirm your delivery preference or to clarify what to do if no one is home. Upon arrival, the driver will knock, ring the doorbell, and/or attempt to call the number provided at checkout.

If someone is available to receive the order, the driver will complete the delivery directly. If no one is available and you've provided delivery instructions, the driver will follow those instructions. If no instructions are provided and the driver cannot reach you, the order will be returned to cold storage and sent back out to be delivered the next day we are delivering to your route. 

Secure Entry Locations

If your home is in an apartment, gated community, or location with restricted access, please include complete delivery instructions when placing your order. This may include buzzer codes, gate access, or concierge information.

Drivers will contact you upon arrival. To avoid missed deliveries, we ask that you meet the driver at the front of your building whenever possible. If the driver cannot gain access and you are unreachable, the package will be returned to cold storage. 

Customer Responsibility

The products are vacuum packed and shipped in boxes that may contain dry ice designed to keep products frozen. Once your products are delivered, immediately transfer the beef to your freezer.

Prairie Farm Foods and its delivery partners are not liable for damage, spoilage, or loss after delivery has been completed.

Rescheduled Delivery Process

If the driver is unable to leave the order and cannot complete the delivery due to lack of access or instructions, the package will be returned to cold storage and delivery will be attempted the next day that products are delivered on your route.

After two days of attempted delivery, the order will be cancelled, and a refund issued minus a "Restocking and Handling" Fee of $30.

RETURNS AND REFUNDS

Perishable Products

Due to the perishable nature of our beef products and in accordance with food safety regulations, we are unable to accept returns and all sales are considered final upon delivery.

While we do not offer refunds or replacements, we strive to ensure that our customers are satisfied with the products they receive.  If you have any concerns with your order, we encourage you to e-mail info@priarieranchers.ca

Refund Policy

Refunds may be provided at our discretion for:

  • Products damaged during shipping
  • Orders cancelled before processing 

Delivery Times

We will provide estimated delivery times, but these are not guaranteed. Delivery times may vary due to weather, logistics, or other factors beyond our control.

Risk of Loss

Risk of loss and title for products pass to you upon delivery.

PERISHABLE PRODUCTS POLICY

Product Handling

Our beef products are perishable and require proper handling:

  • Products must be refrigerated immediately upon delivery
  • Follow storage instructions provided with your order
  • Consume products within recommended timeframes 

Process

To request a refund, contact our customer service team within 24 hours of delivery with photos and a description of any issues.

CANCELLATION POLICY

Order Cancellation

You may cancel your order before it enters our processing and packaging stage. Once products are processed and packaged, Orders cannot be cancelled due to food safety requirements.

INTELLECTUAL PROPERTY

Our Content

All content on our Website, including text, graphics, logos, images, and software, is owned by Prairie Farm Foods Inc. or our licensors and is protected by Canadian and international copyright laws.

Limited License

We grant you a limited, non-exclusive license to access and use our Website for personal, non-commercial purposes.

Restrictions

You may not:

  • Reproduce, distribute, or create derivative works from our content
  • Use our content for commercial purposes without written permission
  • Remove or alter copyright notices or other proprietary markings 

PROHIBITED USES 

You agree not to:

Maximum Liability

Our total liability for any claim related to our Products or Services shall not exceed the amount you paid for the specific Products giving rise to the claim.

INDEMNIFICATION

You agree to indemnify and hold harmless Prairie Farm Foods Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of our Products or Services.

FORCE MAJEURE

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, weather conditions, government actions, or supply chain disruptions.

FOOD SAFETY AND DISCLAIMERS 

Handling Instructions

Follow all handling, storage, and preparation instructions provided with our Products. Proper food handling is essential for food safety.

Allergen Information

While our beef products do not contain common allergens, cross-contamination may occur during processing. If you have severe allergies, consult with us before ordering.

Health Claims

Any health or nutritional information provided is for general educational purposes only and should not replace professional medical advice.

GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. 

Dispute Resolution

Any disputes arising from these Terms or your use of our Website shall be resolved through:

  1. Direct negotiation between the parties
  2. Mediation, if negotiation fails
  3. Binding arbitration under the laws of Alberta 

Jurisdiction

You consent to the exclusive jurisdiction of the courts in Alberta for any legal proceedings.

MODIFICATIONS TO TERMS

We may modify these Terms at any time by posting the updated Terms on our Website with a new "Last Updated" date. Your continued use of our Website after such modifications constitutes acceptance of the updated Terms.

SEVERABILITY 

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prairie Farm Foods Inc. regarding your use of our Website and purchase of our Products.
